2. Definitions

Company: Zapply International B.V., trading as Zapply

Customer: any person or legal entity entering into an agreement with Zapply

Consumer: a natural person acting for purposes outside their trade, business or profession

Agreement: any agreement concluded between Zapply and the Customer via the website
3. Applicability
These Terms & Conditions apply to all offers, orders, subscriptions, products and services offered by Zapply through its website.
Any deviations from these Terms & Conditions are only valid if expressly agreed in writing.
The applicability of any additional or deviating terms of the Customer is expressly excluded.
4. Prices

All prices are displayed in EUR or GBP, inclusive of VAT where applicable

Shipping and handling costs are displayed separately at checkout

Zapply reserves the right to change prices at any time

Price changes do not affect orders already placed
For subscriptions, customers will always be informed in advance of any price changes and may cancel before the new price applies.
5. Orders & Payment

Payment is due immediately upon placing an order

Orders are only processed after successful payment

Zapply reserves the right to refuse or cancel orders in cases of suspected fraud, misuse or incorrect information
6. Delivery

Delivery times are indicative and not guaranteed

Delays do not automatically entitle the Customer to compensation
If delivery is delayed by more than 30 days, the Consumer may cancel the order and receive a full refund.
The risk of loss or damage transfers to the Consumer when the product is delivered to the Consumer or to a third party designated by the Consumer.
7. Right of Withdrawal (Cooling-off Period – Consumers)
Consumers in the UK and EU have the right to cancel their order within 14 days of receiving the product, without giving any reason.
To exercise this right, the Consumer must notify Zapply via:

Conditions:

Products must be unused and returned in original packaging

In accordance with applicable consumer protection laws, sealed products that are not suitable for return due to health or hygiene reasons (such as food supplements) cannot be returned once the seal has been broken

Return shipping costs are borne by the Consumer, unless the product is faulty or incorrect

Refunds will be issued within 14 days after receipt of the returned goods
8. Subscriptions

Subscriptions renew automatically unless cancelled

Customers may cancel at any time via their online account or by contacting support

Cancellation applies to future deliveries only

Any benefits already received remain valid unless stated otherwise
9. Warranty & Product Use
Zapply products are covered by the statutory warranty applicable under Dutch and EU law.
The warranty does not apply to damage caused by incorrect use, negligence or failure to follow instructions.
Food supplements are not intended to diagnose, treat, cure or prevent any disease.
10. Complaints
Complaints must be submitted within a reasonable time after discovery via

Zapply will respond to complaints within 14 days of receipt.
11. Liability
Zapply is only liable for direct damages resulting from intent or gross negligence.
Liability is limited to the amount paid for the product concerned.
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
Nothing in these Terms limits or excludes statutory consumer rights under applicable UK or EU law.
12. Force Majeure
Zapply shall not be liable for failure to fulfil its obligations due to circumstances beyond its reasonable control, including but not limited to strikes, supplier failures, transport disruptions, natural disasters or governmental actions.
13. Governing Law & Jurisdiction
These Terms & Conditions are governed by Dutch law.
Consumers may additionally rely on mandatory consumer protection laws applicable in their country of residence.
14. Amendments
Zapply reserves the right to amend these Terms & Conditions.
Material changes will be communicated in advance where reasonably possible.
Consumers may cancel an agreement if a material change negatively affects their rights.
